Requirements for Filing a Small Claims Case

Small claims cases may be filed by:

  • An individual (18 years and older)
  • A partnership - each partner’s full name, address, and phone number are required
  • A corporation - full legal business name, address, and phone number are required
  • A parent or guardian may file on behalf of a minor child.

The above information must also be provided for the party against whom a claim is filed.

Include these documents in your filing:

  • a completed Statement of Claim Form Packet (See list below) Be sure to choose the correct form for your type of case.
  • copies of any contracts, notes, leases, receipts, or other relevant evidence must be attached to your Statement of Claim
  • In addition to the original documents filed, one identical copy of each document must be provided for each defendant, to be utilized for service.

If a plaintiff or his/her attorney fail to appear on the designated court date, the judge may dismiss the claim.

If a settlement is reached between the parties at any time in the proceeding, the plaintiff must notify the Clerk's Office in writing.

You must advise the Clerk’s Office in writing of any change in your mailing address.

Any judgment debtor has 10 days to file a motion for a new trial and 30 days to file an appeal. The Clerk's Office cannot assist with the filing of an appeal.
