Home Solicitation Sales Permit

A Home Solicitation Sale Permit is required for individuals who intend to sell a product or service door-to-door.

The Sarasota County Clerk and Comptroller administers the issuance of permits for use in the unincorporated Sarasota area.

How much does a Home Solicitation Sales Permit cost?

  • $77.00 non-refundable fee paid to Sarasota County Board of County Commissioners
  • $16.05 non-refundable fee for photo paid to Sarasota County Clerk of Court
  • Additional fees for LiveScan background check paid to the LiveScan provider; fees may vary by provider. There is an additional fee to FDLE for processing.

 

What do I need to apply?

  • Valid government issued photo identification
  • LiveScan fingerprinting and criminal history check to be completed before submitting the application to the Clerk and Comptroller’s Office.
  • Application Fee $77.00. Fee is non-refundable
  • Photo Fee $16.05. A Deputy Clerk will take your photo. Fee is non-refundable
  • Proof of FDLE Payment – This receipt is issued upon payment of the fee required to initiate a Criminal History Background Check by the Florida Department of Law Enforcement (FDLE).
  • Return to the Clerk’s Office upon receiving, in the mail, a letter of confirmation of your approved application.

Home Solicitation Sales Permits may be submitted in person at the Clerk and Comptroller’s Sarasota or Venice office locations.

 

Fingerprinting & Criminal History Check

There are two separate fees for fingerprinting and criminal record check services. Please follow the instructions below for each service.

Fingerprinting

You may use any LiveScan fingerprinting service provider.

The Sarasota County Sheriff’s Office Fingerprinting Service is available without an appointment. Please check their website for details.

FDLE Criminal History Record Check

Applicants must initiate the FDLE Criminal History Record Check process within 30 days of having fingerprints taken by submitting payment through the FDLE Civil Applicant Payment System (CAPS).

The TCN number provided upon having your fingerprints scanned is needed to begin the payment process.

Remember to include a copy of the receipt with your permit application.

What Happens after I Apply?

FDLE will provide the Sarasota Clerk’s Office with the results of a criminal history background check, typically within 60 days or less. Our office will notify you by certified mail whether your application was approved or denied. If your permit application is approved, you will need to appear in person at the Clerk’s office to sign to receive your Home Solicitation Sales Permit.

Home Solicitation Sales Permits are valid for one (1) year from the date of issuance.

Who may apply for a Home Solicitation Permit?

Qualified individuals who meet statutory requirements may apply for and be issued a Home Solicitation Sales Permit. The law states that solicitors, salespersons, or agents making calls or soliciting orders on behalf of religious, charitable, scientific, educational, or veterans’ institutions or organizations holding a sales tax exemption certificate are exempt from holding a Home Solicitation Sales Permit.

Can I be denied a Home Solicitation Permit?

An applicant may be denied a Home Solicitation Sales Permit if the Applicant’s Criminal History Record results reveal a criminal history that serves as grounds for denial, and when one or more of the following apply to the Applicant.

  • Convicted of, or entered a plea of guilty of nolo contendre to, a crime in any jurisdiction, regardless of adjudication, involving moral turpitude, fraudulent or dishonest dealing, or the illegal use or sale of a controlled substance.
  • Convicted of, or entered a plea of guilty or nolo contendre to, any of the provisions of Florida Statutes 51.021 – 501.055
  • Obtained a permit by fraud, false statement, misrepresentation, or failure to truthfully answer any question in the required permit application.
  • Failed to obtain the required County or municipal occupational licenses.
  • Failed, in any material respect, to comply with the provisions of Florida Statutes 501.21 – 501.055.

Information for Consumers

The law requires solicitors to carry and display their Home Solicitation Sales Permit at all times while engaged in home solicitation sales. Permits are valid for 1 year. (Florida Statute 501.022(8))
