New Legislation Shifts Sale Fee from Winning Bidder to Plaintiff in Online Property Sales

Karen E. Rushing, Clerk of the Circuit Court and County Comptroller, would like to bring to your attention a recent legislative change. Senate Bill 2506 "Clerk of Court", signed into law on June 16, 2017, amends §45.035(3) F.S. regarding the electronic sale fee for judicial sales. The bill shifts the responsibility of paying the electronic sale fee for a judicial sale from the winning Bidder to the Plaintiff.

For sales scheduled after June 16, 2017, a sale fee will be assessed as costs and paid by the Plaintiff when filing for an electronic sale date. Therefore, both the $70.00 service charge, pursuant to §45.035(1) F.S., and the electronic sale fee of $70.00 (for a total of $140.00) will be due by 5:00 p.m. the day before the judicial sale, or the sale will be cancelled.
